WAIVE, RELEASE, AND HOLD HARMLESS AGREEMENT
In consideration for being granted permission to participate at Sunday Streets, I hereby agree to the following on behalf of myself and all staff, volunteers, and representatives of our organization and their personal representatives, heirs, assigns, and next of kin:
To release, waive and discharge the City and County of San Francisco, and its officers, agents, employees, representatives and contractors (herein referred to collectively as “City”), Livable City and the Sunday Streets Program (collectively “Sunday Streets”) from any and all claims or demands of any kind and from all liability, penalties, costs, losses, damages, expenses, claims, or judgments (including attorney’s fees) resulting from injury, death or damage to myself, any visitor, third parties or property of any kind, which injury, death or damage arises out of or is in any way connected directly or indirectly to participation at Sunday Streets, whether caused by Sunday Streets or the City’s active or passive negligence or otherwise. I understand that this release extends to claims that I do not know or do not expect to exist at the time of the signing of this release, and I hereby waive the protections of California Civil Code Section 1542.
To protect, hold free and harmless, defend and indemnify, the City and Sunday Streets from any and all claims or demands of any kind and from all liability, penalties, costs, losses, damages, expenses, claims, or judgments (including attorney’s fees) resulting from injury, death or damage to any visitor, third parties or property of any kind, which injury, death or damage arises out of or is in any way connected directly or indirectly to participation at Sunday Streets, whether caused by the City or Sunday Streets’ active or passive negligence or otherwise. This indemnity shall include, without limitation, reasonable attorneys’, experts’ and consultants’ fees, investigation costs, and all other reasonable costs incurred by Sunday Streets out the City.
To assume full responsibility for risk of bodily injury or property damage incurred by myself or the organization’s representatives arising either directly or indirectly from participation at Sunday Streets, whether caused by the City or Sunday Streets’ active or passive negligence or otherwise.
To acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that I and/or our organization’s representatives and their households may be exposed to or infected by COVID- 19 by participation at Sunday Streets; and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 may result from the actions, omissions, or negligence of myself and others, including, but not limited to Sunday Streets and the City.

MANDATORY TENT WEIGHTS: If you plan to bring your own tent, you are required to bring weights for each leg of your tent at no less than 30 lbs each. If you do not bring sufficient weights, SF permitting agencies may require you to take down your tent.

For tabletop fliers and outreach materials, bring paperweights!
